What happens after you send the form
- We confirm the clock. From your receipt notice we work out how long you have waited against the processing time USCIS currently publishes, and whether you have reached the threshold for your kind of filing.
- We check for a blocker. A priority date that is not current, an open request for evidence or a consular posture changes the answer, and we tell you if it does.
- We tell you the honest answer. Either your case is ready to file, or it is still too early and we say what to do in the meantime. Filing is a flat $3,500 with the court filing fee and service included.
- You decide. If you go ahead, a licensed attorney signs and files the complaint in the federal district court for where you live, and the government has 60 days to respond once served.
The form takes your contact details and the basics of your case. There is no separate date field: type the Received Date into the message.
